Terms of service

1. Scope

1.1 The General Terms and Conditions of Business regulate the legal relations between concert goers and the Berliner Philharmoniker Foundation (Berliner Philharmoniker/BPh). They are integral part of the contract about ticket purchase.

1.2 These conditions are valid for both subscribers and event/travel agencies and their members unless no other regulations have been agreed upon.

2. Opening Hours

The box offices in the foyers are always opened not later than one hour before the beginning of the concerts. All other opening hours of the box office are announced separately.

3. Programs and concert times

The current concert programs incl. the beginning of the concerts are published in the box office foyers as well as on the official website of the Berliner Philharmoniker. Announced schedules are subject to alteration. Concert guests may be allowed to enter the hall after the concert has already begun, during convenient pauses, if possible.

4. Ticket reservations and advance sales

4.1 Ticket reservations
Reservations for non-local customers are possible according to the available quotas of seats.

Severely disabled persons may order tickets in writing for the special section for disabled guests as well as for any other seats.

The administrative charge amounts to 2.00 Euros per ticket.

Travel and event agencies may make reservation for tickets depending on the allocation of quotas for each season, immediately after the preview for the forthcoming season has been released.

Theatre box offices may purchase tickets for the prevailing advance sale periods within the quotas which are available for this purpose.

The relevant business practice is subject to separate regulations with the theatre box offices.

4.1.1 Method and scope of ticket orders
In principle, each single person may make reservation for only two tickets for a maximum of four concert programs per season.

4.1.2  Receipt and handling of ticket orders
Requests for tickets are accepted after the preview for the forthcoming season has been released and they are dealt with in chronological order. If it is not possible to make reservation for the required tickets the customer will be informed in writing.

4.1.3 Modes to order tickets
Requests for ticket purchase are accepted in writing, via fax, by email or online on our homepage. Telephone order for tickets is possible from the day of the relevant advance sale. Please, address your ticket request via fax to the fax number of our ticket office +49 30 254 88-323. 4.1.4 Modes of payment
Tickets may be paid with credit cards (Visa, American Express, Eurocard) or bank transfer.
The tickets will be sent by (ordinary) mail. If the customer chooses the option bank transfer the requirement for reservation should, in principle, arrive in the ticket office of the Berliner Philharmoniker eight weeks before the concert. In case seats are available the customer is submitted a written offer together with the corresponding invoice. As soon as the demanded amount has been credited in favor of the account of the Berliner Philharmoniker within the deadline mentioned on the invoice, the tickets will be sent by (ordinary) mail.

4.1.5 Withdrawal from a reservation agreement
In case of delayed receipt of payment, the BPh allocate the reserved tickets to somebody else without replacement and the amount is refunded. Customers are entitled to withdraw from reservation for those concerts which have been postponed. If tickets are not returned on due time before the concert the claim for refund will lapse in case resale of the returned tickets is not possible.

4.2 Ticket sales at the box office in the Philharmonie 

The advance sale for the concerts of the Berliner Philharmoniker begins, for a couple of concert series, on the Sundays which have been published with the release of preview for the forthcoming season. Waiting numbers are neither assigned nor accepted. In principle, the number of tickets for all concerts is strictly limited to two tickets per person and program on the first day of the relevant advance sale period. The number of tickets per person and program is not limited from the second day onwards. Severely disabled persons with official documents are treated with preference. The procedure is the following: one severely disabled person is allowed to join the queue with preference after four other customers. In this connection, all customers are kindly asked to follow the instructions of the service staff members. If tickets are sold for standing room they will be available for purchase only on the day of the concert and not earlier than one hour before the beginning of the concert. Each customer may purchase one ticket, only.

4.3 Exchange and return of tickets
Customers are not entitled to return or to exchange purchased tickets. Changes of programs and/or conductors and artists do, as well, not grant the right to return or to exchange purchased tickets.

4.4 Lost tickets
The BPh do not issue replacement or pay compensation for lost tickets, in principle.

4.5 Resale of tickets
Public and commercial resale of tickets is not permitted. This rule does not apply to customers whose business activities also comprehend the resale or distribution of tickets or whose bylaws provide for resale and delivery of tickets to members or other groups of persons. It is strictly forbidden to offer tickets for resale on the terrain of the Philharmonie.

4.6 Administrative charge
The administrative charge for making reservation of tickets amounts to 2 Euros per seat. Administrative charges are not refunded in case of ticket return.

5. Subscriptions

5.1 General regulations
The following conditions apply to all subscriptions. The subscriber accepts these regulations with signing her/his subscription contract. 

5.2 Group of people
In principle, subscriptions are sold to natural persons, only.

5.3 Scope of subscriptions
Each subscription for concerts of the Berliner Philharmoniker is valid for one single season and includes one seat of a series per subscription.

5.4 Subscription prices
The price for each subscription comprehends both the administrative charges and the ticket prices as well as charges for the cloakrooms. 

5.5 Mode of payment
All subscriptions have to be paid by direct debiting, in principle. The subscriber’s account is always charged on 1 July of the corresponding year.

5.6 Delivery of tickets
The subscription tickets for the forthcoming season are sent after 20 August but not later than one week before the date of the first concert in a subscription series.

5.7 Exchanges and return of tickets
Customers are not entitled to return or to exchange purchased subscription tickets.

5.8 Changes and postponements
Changes of programs and/or conductors and artists are subject to alteration and do, as well, not grant the right to return or to exchange purchased subscription tickets. The Berliner Philharmoniker reserve for themselves the right to change the scheduled seats if necessary for organizational or artistic reasons.

5.9 Renewal of subscriptions
Subscriptions are renewed for each season. If the subscriber has authorized the Berliner Philharmoniker to charge her/his account with the amount for her/his subscription the commitment for the annual renewal is dropped. In this case, the subscription is renewed automatically until the authorization for charging the subscriber’s account is withdrawn and if the subscription is not cancelled by one of the two contracting partners not later than 15 June of the respective year. The date of the postmark is valid for the cancellation. If the subscriber ha not authorized the Berliner Philharmoniker to charge her/his account the subscription is renewed automatically with the settlement of the invoice that was sent, on the due date.

The Berliner Philharmoniker reserve for themselves the right to terminate a subscription without notice in case a subscriber violates the conditions of the subscription contract. This also applies to cases when a subscriber disturbs concert performances repeatedly or interferes with them in any other way. Please, see also paragraph No.8 of these terms and conditions. In such case, the subscriber has to return the tickets for all her/his remaining concerts to the Berliner Philharmoniker immediately. After their return, the subscriber will be partially refunded her/his subscription amount. Subscriptions which are not renewed or not paid on due time are reassigned to somebody else.

5.10 Resale of subscription tickets
Public and commercial resale as well as offering subscription tickets for resale are not permitted on the terrain of the Philharmonie.

5.11 Changes of name, address, banking arrangements
The subscriber is obliged to communicate changes of her/his name, address and banking arrangements to the subscription office in writing immediately.

5.12 Loss of subscription tickets
If a subscriber loses one of her/his tickets he/she can be issued a replacement ticket on presentation of her/his personal identity document. The administrative charge for this procedure amounts to 3 Euros. In such cases, the original ticket becomes invalid.

6. Cloakrooms

Coats and other items may be left free of charge in the cloakrooms in the foyers when the Berliner Philharmoniker Foundation is the organizer of the concert. These cloakrooms are operated by our hired service partner. This cloakroom tenant insures the coats and other items left with him against loss in accordance with the posted insurance conditions. It is forbidden to bring disturbing items, first of all bulky items (i.e. rucksacks etc.), cell phones and animals into the hall. In case of any infringement, domiciliary right may find application (compare No. 8).

7. Lost & found

Objects of all kind which are found in the Philharmonie have to be handed over to the lost and found office of the BPh. Loss of articles may also be reported to the lost and found office.

8. Domiciliary right

Visitors may be refused entry if there are reasons to assume they are going to disturb the performance or annoy other guests. Entry may also be refused if the visitor violates the General Terms and Conditions of Business. Persons who obstruct the ticket sale or disturb the audience can be expelled from the house. Visitors can be asked to leave the running performance if they disturb the performance or annoy other guests, or occupy a seat for which they cannot present a valid ticket. The instructions of the staff members have to be followed.

9. Visual and audio recordings

The production of visual and audio recordings of any kind is forbidden, in principle. The Berliner Philharmoniker reserve for themselves the right to allow visual and audio recordings and transmissions, resp., of selected performances.

10. Declaration of consent

Concert goers give their approval of these General Terms and Conditions of Business with purchasing a ticket or signing a subscription agreement. 

11. Coming into effect

These General Terms and Conditions of Business come into force on 1 July 2014 and replace all previous versions.
